1. Product informationa. Pricing Prices of products, shipping costs and other charges displayed on the our website are subject to change from time to time without notice. b. Description of product As our merchandise is comprised of semi precious stones and other materials (both natural and man made) which have not been mass produced there may be slight variations of colour and shape from time to time. c. Availability of merchandise While we endeavour to keep our stock levels up to date there may be occasions when an order/ purchase is accepted into our system and the item is out of stock. In these circumstances and immediately we become aware of this we will contact you to offer either a full refund or suggested delivery date when the stock is available. 2. Placing an orderBy completing an order, you are making an offer to purchase the merchandise at the price set out on the website. a. Payment must be made at the time of submitting the order. b. Once the order has been successfully placed and paid for, you will view a confirmation page, showing your details, the order’s details, and the payment information. c. We will email you a tax invoice confirming your order. d. You will receive a second and final email notifying you when your order has been packed and dispatched. Included in this email will be your parcel consignment number so that you can track your parcel via www.auspost.com.au/eparcel until it is delivered. e. Your parcel will contain a copy of your receipt and order details. Please keep these documents in a safe place. f. We reserve the right to refuse your purchase order, and refund any payment made by you or on your behalf, at any time. g. All transactions are settled in Australian Dollars. As we are unable to estimate current exchange rates and bank or credit provider fees the final purchase amount charged to foreign based credit cards may differ slightly to account for current exchange rates and bank credit provider fees. h. When you purchase merchandise from us we will require you to provide your name, address, email address or other details ("customer information"). We may subsequently require further details to enable the processing of any orders that you make. By Us: We reserve the right not to provide merchandise, to terminate membership accounts, alter the website from time to time, to cancel orders (or part thereof) without notice to you. Without limiting the operation of any other Terms, we will not be held liable for loss or damage arising from the exercising of these rights. b. By You: If you wish to cancel an order, you must contact us immediately and no later than 2 working days after placing your order by emailing us. Acceptance of the cancellation of your order is at our discretion. Orders that are not cancelled are subject to our Terms as they relate to Returns and Exchanges and as referred to in 5 below. 5. Returns and ExchangesDefective or damaged merchandise a. You must notify us in writing via email to our website at mimiandme.com.au. immediately and no later than 2 days of receipt of your merchandise if, in your opinion, it is defective or damaged. b. You must return defective or damaged merchandise within 14 days of purchase by registered mail through Australia Post unless another method of return is agreed to in writing by us. c. You must ensure that you have taken all reasonable steps to ensure that the merchandise is returned packaged so as to ensure they it is not damaged in transit. Failure to do this may result in us declining to refund your payment or repairing or replacing the merchandise. d. We will not accept the return of merchandise and will not repair or replace merchandise that has, in our opinion, been used. e. We take no responsibility for receipt of the returned merchandise until it is received by us. We will notify you by email once we have received the merchandise. f. If we find that the merchandise is defective or damaged when received by us and we are satisfied that the defect or damage was not caused by you or in transit back to us, we will refund your payment for the merchandise and shipping using the method of payment used by you at the time of purchase. We will also re-imburse you for the cost of returning the merchandise to us through registered mail with Australia Post. Alternatively, if we find the merchandise is defective or damaged when received by us and we are satisfied that the defect or damage was not caused by you or in transit back to us and you request the merchandise to be replaced, we will ship to you replacement merchandise (subject to availability) and at our cost. Incorrect order shipped by us If you receive from us merchandise that you had not ordered and we are satisfied that is the case, we will accept the return of the merchandise at our cost through Registered Mail with Australia Post unless otherwise agreed by us and will ship your order to you as soon as possible thereafter (subject to availability) at our cost. 6. ShippingYour merchandise will be shipped through Registered Mail with Australia Post. All orders will be dispatched as soon as possible after the order and payment are received. International All International orders will be sent by Registered Mail International through Australia Post. You will be provided with a tracking number in the Dispatch Notification we send to you by email. You are required to keep this record. Please note Registered Mail requires delivery signatures to verify that you received your parcel. These charges may be varied from time to time by Registered Mail International Australia Post. Such variations will not be posted to this website on all occasions. It is your responsibility to confirm the charges applicable to your particular parcel at the time of purchase. Important customs notice Customs or Duty for Orders outside Australia: Incorrect Addresses: It is your responsibility to enter the correct shipping address details at the time of ordering. Should you enter the wrong address and the goods have not been returned to us within 21 days of shipping we will not refund your payment or replace the goods for you. Parcel Does Not Arrive: It is your responsibility to inform us by email if an order does not arrive within 21 days. Once we receive your advice that the merchandise has not arrived we will make enquiries of Australia Post to try and determine the location of it. However, (a) We will not be held liable for any loss or damage resulting from late delivery by Australia Post.
